Terms of Service

These terms govern your use of MarkWise's web and mobile applications. By creating an account or otherwise using MarkWise, you agree to them. If you don't agree, please don't use the service.
1. Who can use MarkWise
MarkWise is provided to students, lecturers, and administrators through their educational institution. Your access is tied to your institution's own enrollment and staffing records, and your institution controls who is onboarded, suspended, or removed.
2. Your account
You're responsible for keeping your login credentials and any device you use to mark attendance secure. Attendance marked from your account is treated as your own attendance — notify your institution promptly if you believe your account has been compromised or used without your authorization.
3. Acceptable use
You agree not to:
- Mark or attempt to mark attendance on behalf of someone else, or ask another person to do so on your behalf, except through the app's own lecturer-authorized delegation feature.
- Attempt to spoof, replay, or otherwise circumvent the Bluetooth, QR, PIN, or biometric verification mechanisms used to record attendance.
- Access or attempt to access data belonging to another institution, or another user outside your own permitted role.
- Reverse-engineer, disrupt, or overload the service, or use it for any purpose beyond attendance management for your institution.
Attendance is an academic record. Falsifying it may result in consequences under your institution's own academic integrity policies, independent of any action MarkWise takes on the account.
4. Attendance data and accuracy
MarkWise is a tool to help your institution record attendance reliably, using multiple verification methods layered together (Bluetooth, QR, PIN, WebAuthn passkeys, and lecturer-assisted manual marking). We work to keep it accurate and available, but MarkWise is not a substitute for your institution's own academic policies, and your institution — not MarkWise — is the authority on your official attendance record and any consequences tied to it.
5. Service availability
We aim to keep MarkWise available and reliable, including offline-first behavior on mobile so attendance can still be recorded and synced once connectivity returns. We don't guarantee uninterrupted availability, and we may need to modify, suspend, or discontinue parts of the service, with reasonable notice where practical.
6. Termination
Your institution may suspend or remove your access at any time in line with its own enrollment/employment status. You may also delete your own account at any time from the mobile app's Settings, which permanently removes your personal data as described in our Privacy Policy.
7. Changes to these terms
We may update these terms as the service evolves. Continued use of MarkWise after an update means you accept the revised terms; material changes will be reflected by updating the date above.

These terms describe MarkWise's product as implemented. They are not a substitute for legal advice — institutions should have them reviewed against their own contractual and regulatory needs before relying on them.
